General Terms of Service

These General Terms of Service (“Terms”) govern access to and use of the kart-center.com service, published by ODOWA (“we”). By creating an account or subscribing, the user accepts them without reservation.

1. Purpose and description of the service

kart-center is a karting platform offering:

• Free and without an account: a worldwide directory of circuits, live timing, race results and archives, and their replay.
• With a free account (sign-in via Google): creating a team, claiming a circuit listing, and declaring one’s races.
• With a paid Pro subscription: endurance race-engineering tools (strategy, live follow-up, statistics) and race management.

2. User account

Accounts are created via a third-party identity provider (Google). The user undertakes to provide accurate information and to keep their access confidential. The user is responsible for activities carried out from their account.

3. Pro subscription, pricing and payment

The Pro subscription is offered at the price shown on the site (€39 per month as of these Terms), billed monthly via our payment provider Stripe. Card data never passes through our servers. The subscription renews automatically each month, with no minimum commitment, and may be cancelled at any time; cancellation takes effect at the end of the current monthly period, with no refund for the period underway. We may change prices with 30 days’ notice; a user who disagrees may cancel.

4. Term and termination

The service is provided for an indefinite term. The user may delete their account (free service) or cancel their subscription (Pro service) at any time. We may suspend or terminate access in the event of a breach of these Terms, where applicable after a formal notice left unheeded for 30 days.

5. User obligations

The user undertakes to use the service lawfully and fairly, not to harm its integrity or security, not to extract its data en masse by automated means, and not to publish unlawful content.

6. Timing data and removal

kart-center aggregates timing and results data publicly broadcast by circuits and their providers (notably Apex Timing). This data may include participants’ names or nicknames. A circuit, organiser or participant may request the rectification or removal of data concerning them by writing to [email protected].

7. Intellectual property

The service, its trademarks, code, databases and interfaces remain the exclusive property of ODOWA. The user is granted a personal, non-exclusive and non-transferable right of use, limited to the duration of their subscription and their own needs.

8. Liability and warranties

The service is provided on a best-efforts basis and “as is”. We do not guarantee uninterrupted availability and cannot be held liable for interruptions beyond our control (force majeure, failure of a third party or infrastructure, maintenance, misuse). As timing data comes from third-party sources, it is provided without any warranty of accuracy or completeness. To the extent permitted by law, our liability is capped at the amount actually paid by the user over the last 12 months, and we cannot be held liable for indirect damages (loss of data, profits or business).

9. Personal data

The processing of personal data is described in our Privacy Policy.

10. Changes to the Terms

We may update these Terms. Substantial changes are notified with 30 days’ notice; continued use constitutes acceptance.

11. Governing law and disputes

These Terms are governed by French law. The parties shall seek an amicable solution before any legal action. Failing that, the competent courts of Paris shall have jurisdiction, without prejudice to the mandatory consumer-protection rules allowing a consumer user to bring proceedings before the courts of their place of residence.
